Terms of Service

1. Acceptance of Terms

By accessing or using any service, product, or website provided by Fozmu Studios ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services

Fozmu Studios provides custom software development, web development, APIs, Discord bots, Minecraft servers, games, and related digital services. The specific scope, timeline, and deliverables of any project are defined in a separate project agreement or statement of work signed by both parties.

3. Use of Services

You agree to use our services only for lawful purposes. You must not:

• Use our services to violate any applicable laws or regulations
• Attempt to gain unauthorized access to our systems or infrastructure
• Resell, sublicense, or redistribute our work without explicit written consent
• Use our deliverables in ways that infringe on third-party intellectual property rights
• Provide false or misleading information during any project engagement

4. Intellectual Property

Upon full payment for a project, the client receives ownership of the final deliverable as agreed in the project contract. Fozmu Studios retains the right to use general frameworks, tools, and methodologies developed during projects in future work unless otherwise specified. Portfolio display rights are retained by Fozmu Studios unless a non-disclosure agreement is in place.

5. Payments

Payment terms are defined per project. Work begins upon receipt of any agreed-upon deposit. Fozmu Studios reserves the right to pause or terminate work if payments are overdue. Refunds are handled on a case-by-case basis and are outlined in individual project agreements.

6. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of a project. This includes but is not limited to business data, technical specifications, pricing, and project details, unless disclosure is required by law.

7. Limitation of Liability

Fozmu Studios shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability for any claim arising out of a project shall not exceed the amount paid by the client for that specific project.

8. Warranties

We provide our services on a reasonable-efforts basis and do not guarantee that deliverables will be error-free or meet every business objective. Any warranty period and remedies are defined in the individual project agreement.

9. Termination

Either party may terminate a project engagement with written notice as specified in the project agreement. Upon termination, the client is responsible for payment of work completed up to the termination date.

10. Governing Law

These terms are governed by the laws of the jurisdiction in which Fozmu Studios is registered. Any disputes shall be resolved through good-faith negotiation; if unresolved, through binding arbitration.

11. Changes to Terms

We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated date. Continued use of our services after changes constitutes acceptance of the revised terms.
